Welcome to Be Travelist. These Terms of Service (“Terms”) govern your use of our website and the booking of our mindful Himalayan treks, offbeat escapes, and related services. By accessing our website or booking a journey with us, you agree to be bound by these Terms.

1. Acceptance of Terms

By booking a trip with Be Travelist, you acknowledge that you have read, understood, and agreed to these Terms, as well as our Privacy Policy and Refund Policy. If you are booking on behalf of a group, you guarantee that you have the authority to accept these Terms on behalf of all members of your party.

2. Booking, Pricing, and Payments

Confirmation: A booking is only confirmed once the required advance payment is received and a formal confirmation email is sent by our team.
Pricing: All prices are quoted in Indian Rupees (INR). We reserve the right to change our pricing at any time before a booking is confirmed.
Full Payment: The complete balance must be paid before the commencement of the journey, as network connectivity in remote Himalayan regions is often unavailable.

3. Health, Fitness, and Medical Conditions

Physical Fitness: Himalayan treks require a basic to advanced level of physical fitness. It is your responsibility to ensure you are medically and physically fit for the chosen itinerary.
Disclosure: You must disclose any pre-existing medical conditions (e.g., asthma, heart conditions, blood pressure issues) at the time of booking.
Guide’s Authority: For your safety, our certified Trek Leaders have the absolute authority to stop a participant from continuing a trek if they believe the participant’s health is at risk.

4. Assumption of Risk

Adventure travel in the Himalayas involves inherent risks, including but not limited to unpredictable weather, landslides, altitude sickness (AMS), and rugged terrain. By booking with Be Travelist, you acknowledge and voluntarily assume these risks. We prioritize safety above all else, but we cannot be held responsible for injuries, delays, or damages caused by nature or circumstances beyond our control.

5. Itinerary Changes & Unforeseen Circumstances

The Mountains Decide: We plan our itineraries meticulously; however, weather conditions, road blocks, or political situations in the mountains can change rapidly.
Alterations: Be Travelist reserves the right to modify or cancel routes, campsites, or schedules for the safety of the group. In such events, we will provide the best possible alternative, but no refunds will be issued for itinerary changes dictated by Acts of God or safety concerns.

6. Mindful Travel & Code of Conduct

Environmental Respect: We are a slow and mindful travel brand. Littering, damaging flora/fauna, or disrespecting local culture is strictly prohibited. You are expected to bring your trash back to the base.
Zero Tolerance: The consumption of alcohol, illegal drugs, or any intoxicating substances during active trekking days is strictly banned. Our guides reserve the right to expel any participant violating this rule without any refund.

7. Limitation of Liability

Be Travelist, its founders, guides, and local partners shall not be held liable for any direct, indirect, incidental, or consequential damages, loss of property, injury, or death arising from your participation in our trips, except where such liability is mandated by Indian law.

8. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms or your journey shall be subject to the exclusive jurisdiction of the courts in Dehradun, Uttarakhand.
